The following terms and conditions may be amended from time to time. They apply to all our services made available online. By accessing this website, we assume that you have read and understood, and that you accept these terms and conditions in full. Please do not continue to use Wheel the World website if you do not accept all of the terms and conditions stated on this page.

The relationship that we have with our partners and Tour Providers are governed by separate terms and conditions. Each Tour Provider acts in a professional manner vis-à-vis Wheel the World when making its product/service available on Wheel the World website. Please note that Tour Providers may have additional terms and conditions.

This Participation Agreement (“Agreement”) is made and entered into by and between the individual participant listed on the signature page of this Agreement, (“Participant”), who represents the group of participants he/she will be traveling with; and Wheel the World Inc., a Delaware public benefit corporation (“WTW”) (collectively, the “Parties”), and is effective as of the date of Participant’s signature on the signature page. In consideration of the opportunity to participate in the Excursion (as defined below), the Participant agrees as follows:

I. Excursion, Conduct, & Cooperation.

WTW is excited that the Participant has agreed to take part in a life-changing adventure (the “Excursion”) that is described in the itinerary purchased at https://wheeltheworld.com (the “Itinerary”). The terms of this Agreement shall apply to all activities described in the Itinerary. It is critical that all participants help foster a mutually supportive environment. As such, the Participant agrees to be considerate of, and patient with, other participants, as well as all WTW personnel. Participants also agree to read all material provided by WTW in advance of the Excursion, to adequately prepare for the Excursion, and to follow all directions from WTW prior to and during the Excursion.

II. Assumption of Risk.

WTW has conducted reasonable safety and accessibility assessments related to the outdoor activities to be done during the Excursion. WTW personnel have also been trained to assist and provide guidance and help to the Participant. The Participant is engaging in the WTW Excursion voluntarily and understands that WTW cannot and does not guarantee Participant’s personal safety. Participant agrees that participation in recreational and other activities conducted by or in conjunction with the Excursion, along with travel to and from such activities, involves inherent risks such as physical injury, illness, death, or loss of personal property. The Participant also understands that some injuries may require special treatment, personnel, and equipment which may be remote either by time or distance or both, from the Excursion site. Participant expressly waives and releases any and all claims, now known or hereafter known, against the WTW and its officers, employees, agents, affiliates, successors, and assigns (collectively, "Releasees"), on account of injury, illness, disability, death, or property damage arising out of or attributable to participation in the Excursion, whether arising out of the ordinary negligence of WTW, any Releasees, or otherwise. Participant covenants not to make or bring any such claim against WTW or any other Releasee, and forever releases and discharges WTW and all other Releasees from liability under such claims.

III. Limitation & Release of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PARTICIPANT HEREBY ABSOLVES, RELEASES, AND WAIVES ANY AND ALL LIABILITY, CLAIMS, OR DEMANDS AGAINST WTW AND ITS MEMBERS, OFFICERS, DIRECTORS, AGENTS, INSTRUCTORS, TRIP LEADERS, AND CONTRACTORS, AS WELL AS THE PROPERTY OWNER(S) WHERE THE EXCURSION WILL OCCUR (IF ANY), FROM ANY AND ALL CLAIMS, DEMANDS, RIGHTS, AND CAUSES OF ACTION ARISING FROM AND BY REASON OF ANY AND ALL KNOWN AND UNKNOWN, FORESEEN AND UNFORESEEN BODILY AND PERSONAL INJURIES INCLUDING BUT NOT LIMITED TO SERIOUS INJURY, ILLNESS, DEATH, DAMAGE TO PROPERTY, AND THE CONSEQUENCES THEREOF RESULTING FROM, OR RELATING TO, PARTICIPATION BY PARTICIPANT IN ANY ACTIVITIES CONDUCTED BY OR IN CONJUNCTION WITH WTW.

IV. Medical Information & Release.

As soon as practicable, but not less than three weeks in advance of the Excursion, Participant shall provide WTW with a list and description of all physical and mental health conditions, along with all other medical information requested by WTW, through a medical information form emailed to the Participant by WTW. The Participant represents and warrants that all information provided to WTW is accurate and complete. The medical information provided by Participant will remain confidential and will only be provided to WTW personnel and individuals who have a need to know such information.

WTW reserves the right to disqualify Participant prior to, or at any time during, the Excursion if WTW’s personnel believe Participant is mentally or physically incapable to participate, or continue to participate, in the Excursion and/or if Participant’s participation jeopardizes other participants’ or Participant’s own safety.

WTW strives to make the Excursion available to individuals with physical impairments and that is ultimately the purpose of the Excursion. However, the Excursion may still require significant physical exertion, and the Participant represents and warrants that, after reviewing the Excursion information provided by WTW, Participant has no physical impairment or defect that should preclude participating in the Excursion. The Participant is solely responsible for administering any medications or vaccinations that the Participant or the Participant’s doctor deem necessary and WTW is not responsible for providing any medical advice or administering any such medications or vaccinations. Medical facilities for serious problems may be unavailable during the Excursion and evacuation can be prolonged, difficult, and expensive. The Participant agrees to pay for any emergency evacuation and emergency medical care required to be provided to the Participant. The Participant gives consent to WTW to secure, at the Participant’s sole expense, rescue/evacuation services, and medical treatment and further agrees to the performance of such treatment as may be deemed necessary in the opinion of an attending physician.

V. Insurance.

The Participant acknowledges and agrees that Participant is not covered by any insurance held by WTW. It is mandatory that Participant purchase appropriate and sufficient insurance coverage. Participant hereby represents and warrants that Participant has sufficient health, accident, and liability insurance to cover (i) any and all bodily injury or illness (including COVID 19) and/or property damage that Participant may incur while preparing for, participating in, and traveling to and from the Excursion; (ii) emergency evacuations; and (iii) bodily injury or property damage that Participant may cause to any third party.

VI. Fees; Cancellation; and Refunds.

The Participant’s enrollment and involvement in the Excursion are contingent on payment in full of all applicable fees as specified by WTW. To maintain the quality of hands-on instruction, each WTW Excursion enrolls a limited number of participants. When individuals cancel near the beginning of the Excursion date, it prevents other potential participants from enrolling. In addition, while “invisible” to the participant, time and money are spent preparing for participants to attend excursions. WTW’s cancellation and refund policy reflects the fact that it is impossible to recover these upfront costs and that actual damages are impossible to calculate at the time of this Agreement. Participant therefore acknowledges and agrees that the cancellation and refund policy specified below reflects a fair and reasonable estimate of the actual damages that WTW will incur. The fees, cancellation, and refund policy is as follows:

  • The Excursion price includes all of the items described in the Itinerary except for (i) air transportation of the Participant and (ii) food, drinks, and spa treatments that are not covered in the hotel packages. The Participant shall pay the Excursion price at the time of registering for the Excursion.
  • If Participant fails to attend the Excursion, arrives late for the Excursion, or leaves the Excursion for any reason once it has begun, no refund will be provided (no exceptions).
  • If Participant decides to cancel the Excursion for any reason before the Excursion has begun, the Participant should notify WTW in writing as soon as possible. In such case, WTW will make commercially reasonable efforts to obtain refunds from all applicable service providers and will provide any such refund to the Participant. However, the Participant agrees and understands that WTW makes no guarantees as to the amount of refund, if any, that WTW is ultimately able to provide.
  • WTW assumes no responsibility for any additional expenses incurred as a result of cancellation.
  • WTW assumes no responsibility for any cancellations of activities that might occur due to the weather conditions at the destination of the Excursion. Nevertheless, WTW will always provide options to reschedule the activities.
  • Payment of all fees may be made by cash, check, or credit card, at WTW’s sole discretion.
  • Stay at accessible room requested or get your money back: Upon arrival at the Wheel the World hotel booked, if the room accessibility does not match the accessibility information provided in the Hotel listing at https://wheeltheworld.com/, a refund for the price of the first night's stay shall be promptly issued to the credit card on file. In the event that the stay exceeds one night, an alternative room will be made available to the traveler, aligned with the accessibility needs of the traveler for the duration of their stay. Should the traveler find the alternative room unsatisfactory, a refund shall be considered on a case-by-case basis and mutually agreed upon terms.It is hereby specified that the clause regarding the immediate refund applies solely to hotel bookings made through Wheel the World that result in a negative experience.Refunds shall not be issued to travelers or their companions who have failed to complete and submit an accessibility profile prior to making a reservation. Travelers and their companions who have not completed an accessibility profile prior to making a reservation, shall not be entitled to a refund.

VII. COVID 19.

The Participant is responsible for any documentation and tests that are required by the local healthcare authorities at the destination of the Excursion and during the Excursion. This includes, but is not limited to, vaccination certificates in English as well as PCR tests.

VII. Privacy Policy.

In addition to the terms outlined herein, this Agreement incorporates and includes the entirety of our Privacy Policy with regard to data collection, correspondence, cybersecurity and similar matters, a copy of which may be found at https://wheeltheworld.com/privacy-policy/.

IX. Miscellaneous.

  • (a) Age. Participant represents and warrants that Participant is eighteen (18) years of age or older or, if not, the undersigned parent or guardian agrees to be bound by the terms of this Agreement on behalf of the minor.
  • (b) Governing Law; Venue. This Agreement shall be governed by the laws of the State of California, without regard to conflict of law provisions. The Parties agree that any dispute will be brought in Alameda County, California or, in the case of exclusive federal jurisdiction, in the courts of the Northern District of California. Both Parties consent to venue and personal jurisdiction in such location.
  • (c) Arbitration. In the event of disputes between the parties arising from or concerning any manner related to the subject matter of this Agreement, the parties will first attempt to resolve the dispute(s) through good faith negotiation. In the event that the dispute(s) cannot be resolved through good faith negotiation, the parties will refer the dispute(s) to a mutually acceptable mediator. In the event that such dispute(s) cannot be resolved through mediation, the parties will refer the dispute(s) to the American Arbitration Association for resolution through binding arbitration by a single arbitrator pursuant to the American Arbitration Association’s rules applicable to commercial disputes. Any mediation or arbitration hereunder will be held in Alameda County, California.
  • (d) Successors and Assigns. This Agreement, and the rights and obligations of the Parties hereunder, will be binding upon and inure to the benefit of their respective successors, assigns, heirs, executors, administrators, and legal representatives.
  • (e) Entire Agreement. This Agreement is the entire agreement of the Parties as to the subject matter hereof and supersedes all prior written and oral agreements and understandings relating to the same.
  • (f) Assignment. WTW reserves the right to assign this Agreement and its rights and obligations hereunder without Participant’s consent. The Participant may not assign this Agreement.
  • (g) Severability. Should any provision of this Agreement be held to be void or unenforceable, the remaining provisions shall remain in full force and effect.
  • (h) Amendments and Waiver. No modification of or amendment to this Agreement, nor any waiver of any rights under this Agreement, shall be effective unless in writing signed by the Parties to this Agreement. No delay or failure to require performance of any provision of this Agreement shall constitute a waiver of that provision.
